Google Book Search and the question of Fair Use

Lawrence Lessig asks if the Google Book Search is fair use. There is an mp4 of the presentation on this topic, available by torrent here.

I think the question of fair use is very apt when it comes to what is in search, and who owns what. The "we own your content" thing has come up quite often with relation to Google, and specifically with relation to using AdSense, so these questions always pique my interest.
